GROSS BIN BUSTERS TERMS OF SERVICE

Effective Date: January 1st, 2026

This document constitutes a legally binding agreement (the “Agreement”) between Gross Bin Busters (“Company,” “we,” “us,” or “our”) and any individual or entity who schedules, receives, or otherwise uses our services (“Customer,” “you,” or “your”).

These Terms of Service govern your access to and use of all services provided by Gross Bin Busters. By scheduling an appointment, clicking a box or button indicating your acceptance of these terms, or otherwise using our services, you acknowledge that you have read, understood, and agree to be bound by this Agreement in its entirety. This Agreement sets forth the terms and conditions under which Gross Bin Busters will provide professional cleaning and sanitization services for residential and commercial waste and recycling bins (the “Services”). The terms in this Agreement apply to all service arrangements, including one-time cleanings and recurring service plans.

Please read these terms carefully. If you do not agree with all of these provisions, do not access or use our services.

  1. Term and Termination
    1. Term. This Agreement shall commence on the date the Customer first schedules or uses the Services and shall continue in effect until terminated by either party as provided herein.
    2. Service Plan Renewal. For any recurring services, the term will automatically renew for successive periods of the same duration unless cancelled in accordance with the cancellation policy.
    3. Termination by Customer. You may terminate this Agreement and cancel your Services at any time by providing notice to the Company by emailing grossbinbusters@gmail.com or call and or text 443-624-4999. Cancellation requests may be subject to a notice period and any applicable fees outlined in our cancellation policy.
    4. Termination by Company. We reserve the right to suspend or terminate your access to the Services at any time, for any reason, with or without cause. We may terminate this Agreement immediately and without notice if you breach any material term, including failure to make timely payments.
    5. Effect of Termination. Termination of this Agreement will not relieve you of your obligation to pay any outstanding fees owed to the Company for Services rendered prior to the effective date of termination.

  2. Access, Scheduling, and Service Location
    1. Customer Responsibility for Access. On your scheduled Service Day, you are required to ensure your Bins are empty and placed at the designated Service Location. The Service Location is the curbside of the address provided, easily accessible to our service vehicle.
    2. Access Limitations. Our personnel are prohibited from entering private property beyond the curbside to retrieve Bins. This includes, but is not limited to, garages, backyards, enclosed patios, or behind gates. It is your responsibility to ensure Bins are free from obstruction.
    3. Inaccessible Bins. Bins will be considered inaccessible if they are not at the designated Service Location, are blocked by vehicles or other objects, contain unbagged hazardous waste or animal remains, are overfilled to the point of preventing safe handling, or are otherwise unable to be serviced for reasons within your control.
    4. Missed Service Due to Inaccessibility. If we arrive at your Service Location and are unable to perform the Services because your Bins are inaccessible, the service will be forfeited for that date. In such an event, you will be charged a Missed Service Fee as defined in this Agreement. We will not automatically reschedule the service.

  3.  Fees, Payments, and Price Changes
    1. Service Fees. The fees for our Services shall be as set forth on our website or as otherwise quoted to you at the time of booking (“Service Fees”). All Service Fees are due in advance of the scheduled Service Day unless otherwise specified in your service plan.
    2. Payment and Authorization. You agree to provide a valid payment method and authorize us to charge the Service Fees to this payment method. For recurring Services, you authorize Gross Bin Busters to automatically charge your payment method on file at the beginning of each billing cycle. It is your responsibility to keep your payment information current.
    3. Late Payments. Failure to make a timely payment may result in the suspension of your Services. A late fee of $10 may be applied to any invoice not paid within 30 days of its due date. We reserve the right to charge interest on overdue amounts at a rate of 1% per month or the highest rate permitted by law, whichever is lower.
    4. Price Changes. We reserve the right to modify our Service Fees. We will provide you with at least thirty (30) days’ written notice (which may be sent via email) of any price increase. If you do not agree to the new price, you may cancel your Services in accordance with the cancellation policy prior to the effective date of
      the price change. Your continued use of the Services after the price change becomes effective will constitute your acceptance of the new price.

  4. Missed Services, Cancellations, and Fees Reconciliation
    1. Missed Service Fee. As stated in Section 2.C., if our team arrives at your Service Location and is unable to perform the Services due to inaccessible Bins, the service for that date is forfeited. You will be charged a Missed Service Fee, which is equal to the full price of the scheduled Service, to cover our operational costs. No refund or credit will be issued for that Service Day.
    2. Cancellation Policy. You may cancel your one-time or recurring Services by providing notice of at least 24 hours before your next scheduled Service Day. Cancellations can be made through grossbinbusters@gmail.com, or by responding to our confirmation text message. Cancellations made with less than the required notice may be subject to a cancellation fee equivalent to the Missed Service Fee.
    3. Refunds. Service Fees are non-refundable for Services that have already been performed. For prepaid service plans, refunds for future, unused Services upon cancellation will be governed by the specific terms of your service plan. Missed Service Fees and late cancellation fees are non-refundable.
    4. Rescheduling. You may request to reschedule a Service by providing at least 24 hours of advance notice. We will make a reasonable effort to accommodate your request, subject to our availability. Rescheduling requests made with insufficient notice will be treated as a late cancellation.

  5. Limitation of Liability and Disclaimer of Damages
    1. Limitation of Responsibility. Gross Bin Busters is not liable for any pre-existing damage to your Bins, including but not limited to cracks, scratches, dents, or warping. Furthermore, we are not responsible for any damage caused to your Bins by third parties, such as your municipal or private waste collection service, before or after our Services are rendered.
    2. Disclaimer of Damage to Property and Service Area. You are responsible for ensuring the Service Location is clear and prepared for our arrival. This includes moving vehicles, protecting vulnerable landscaping or decorative items, and ensuring the area is free from obstructions. Gross Bin Busters is not liable for damage to property at or near the Service Location that may occur as an incidental result of our standard cleaning operations. This includes, but is not limited to, damage to driveways (e.g., water spots, minor fluid drips from our vehicle), curbs, lawns, landscaping, sprinkler heads, or mailboxes.
    3. Maximum Liability. The Customer agrees that the Company’s maximum aggregate liability for any claim, loss, or damage arising out of or relating to this
      Agreement or the Services provided, whether based in contract, tort (including negligence), or any other legal theory, is strictly limited to the amount you paid for the specific Service giving rise to the claim.
    4. Disclaimer of Consequential Damages. TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL GROSS BIN BUSTERS, ITS OWNERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. THIS EXCLUSION APPLIES REGARDLESS OF THE LEGAL THEORY AND INCLUDES, BUT IS NOT LIMITED TO, DAMAGES FOR LOST PROFITS, LOSS OF BUSINESS, OR LOSS OF GOODWILL, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  6. Disclaimer of Warranties
    1. “As Is” and “As Available” Basis. EXCEPT AS EXPRESSLY STATED IN THIS AGREEMENT, GROSS BIN BUSTERS PROVIDES ITS SERVICES ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
    2. No Guarantee of Results. We do not warrant or guarantee that our Services will result in your Bins being completely free of all stains, odors, or residue. The effectiveness of the Services can be limited by factors such as the age and condition of the Bins or the nature of substances they have contained.

  7. Dispute Resolution, Governing Law, and Arbitration
    1. Governing Law. This Agreement and any dispute, claim, or controversy arising out of or relating to it shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law principles.
    2. Mandatory Binding Arbitration. PLEASE READ THIS SECTION CAREFULLY, AS IT AFFECTS YOUR LEGAL RIGHTS. You and Gross Bin Busters agree that any claim, dispute, or controversy (whether in contract, tort, or otherwise) arising out of or relating to this Agreement, the Services provided, or the breach, termination, enforcement, interpretation, or validity thereof, shall be resolved exclusively and finally by binding arbitration. The arbitration shall be administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules then in effect. The arbitration will be conducted in Anne Arundel County, Maryland before a single neutral arbitrator. The arbitrator’s decision will be final and binding, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
    3. Class Action Waiver. YOU AND GROSS BIN BUSTERS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED
      CLASS OR REPRESENTATIVE PROCEEDING. Further, unless both you and the Company agree otherwise in writing, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.

  8. Miscellaneous Provisions
    1. Entire Agreement. This Agreement, including all policies or documents incorporated by reference, constitutes the entire agreement between you and Gross Bin Busters regarding your use of the Services. It supersedes all prior or contemporaneous communications, proposals, representations, and agreements between the parties, whether oral or written, with respect to the subject matter hereof. No other promises, conditions, understandings, or representations shall be binding unless expressly included in this Agreement.
    2. Severability. If any provision of this Agreement is found by a court of competent jurisdiction or an arbitrator to be invalid, illegal, or unenforceable, such provision shall be severed from the Agreement, and the remainder of the Agreement shall continue in full force and effect. The parties agree to negotiate in good faith to replace the invalid provision with a valid provision that most closely approximates the original intent and economic effect of the severed provision.
    3. Relationship of the Parties. Nothing in this Agreement shall be construed as creating a partnership, joint venture, agency, or employment relationship between the parties. The relationship between the Company and the Customer is solely that of independent contractors.
    4. Amendments. Except as expressly provided herein (including, without limitation, our right to modify pricing under Section 3.D), no amendment or modification to this Agreement shall be effective unless it is in writing and signed by authorized representatives of both parties.
    5. Waiver. The failure of either party to enforce any right or provision of this Agreement at any time will not be deemed a waiver of such right or provision for the future. Any waiver of any provision of this Agreement will be effective only if in writing and signed by the waiving party.
    6. Counterparts and Electronic Signatures. This Agreement may be accepted electronically. You agree that your electronic assent, such as by clicking a box or button indicating your acceptance (“I Agree,” “I Accept,” etc.) when scheduling or using the Services, constitutes your electronic signature. Such electronic signature has the same legal force and effect as a handwritten signature and demonstrates your intent to be bound by this Agreement.
    7. Notices. All legal notices to the Company under this Agreement shall be sent to the mailing address listed in this Agreement. All notices to the Customer will be
      sent to the email address associated with your account. Notice will be deemed given twenty-four (24) hours after an email is sent.
    8. Survival. Any provisions of this Agreement that, by their nature, should survive termination shall survive termination. This includes, without limitation, all outstanding payment obligations, disclaimers of warranties, limitations of liability, and dispute resolution provisions.
    9. Governing Language. This Agreement is executed in the English language. In the event this Agreement is translated into another language, the English language version shall control and prevail in case of any conflict or ambiguity.
